Terms of Use
Marker Lab is an app for iPhone, iPad and Mac that teaches painting with acrylic markers. It is made by Dmytro Nikolaienko, an individual entrepreneur registered in Ukraine (“we”). These terms are short on purpose. By using the app you agree to them.
The licence
The app is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the standard EULA). These terms add a few points that are specific to Marker Lab. If something here conflicts with the standard EULA, the standard EULA applies.
Purchases and subscriptions
- Some lessons are free. The rest of the course is unlocked by an in-app purchase or a subscription, at the price shown in the App Store before you buy.
- Payments are made through your Apple account and billed by Apple. Subscriptions renew automatically until you cancel them.
- You manage and cancel subscriptions in your Apple account settings, under Subscriptions. Deleting your Marker Lab account does not cancel a subscription.
- Refunds are handled by Apple under its rules. You can request one at reportaproblem.apple.com.
- On a child’s profile, purchases are behind a parental gate, and Apple’s Ask to Buy works as usual.
Accounts
You can use Marker Lab without an account. Signing in with Apple is optional and syncs progress between devices. If a child uses the app, a parent or guardian sets it up, signs in if needed and is responsible for the child’s use. You can delete the account at any time in the app (For Parents › Sync › Delete account).
Your artworks
What you paint is yours. Photos of your paintings stay on your device, and we claim no rights to them. When you choose to send a photo to the teacher, you allow us and our AI provider to process it only to give you the answer, as described in the Privacy Policy.
AI tips are educational
Teacher’s Tip and A Lesson from Your Photo are optional features that use AI (Claude, by Anthropic). Their answers are suggestions for practice, generated automatically. They can be imperfect or wrong, they are not professional advice and they are not a grade. Use your own judgement, and parents may switch these features off at any time.
Our content
The lessons, paintings, illustrations, printable sheets, texts and the app itself belong to us or our licensors. You may print the sheets and follow the lessons for your own personal, non-commercial use, including with your family. Please don’t resell or republish the course materials.
Painting safely
Marker Lab doesn’t make or sell markers or paper. Follow the instructions and age guidance of the materials you use, and let younger children paint with a grown-up nearby.
Fair use
Please don’t try to break, overload or misuse the app or our servers, for example by sending automated requests to the AI features. We may limit access if this happens.
Changes, availability, law
We keep improving the app, so lessons and features may change. We may update these terms; the date at the top shows the current version. Our liability is limited as set out in the standard EULA and to the extent the law allows. These terms are governed by the laws of Ukraine, without taking away any mandatory consumer rights you have where you live.
